Man 'bitten on penis' by rat can sue jail

A judge has ruled a New Yorker may sue county officials, after he claimed a rat bit his penis during a jail stay.

Peter Solomon, said he later had to endure a series of rabies jab to combat the rodents attack to his genitals. He added that jail staff knew the in which he was held was infested with rodents..

He says they were negligent and mistreated him because he is black.

Stating that their experts saw no evidence of serious injury, lawyers for Nassau County sought to have the suit dismissed.

In February 2007, Mr Solomon, a Vietnam veteran who says he has been treated for post-traumatic stress disorder, was jailed in the Nassau County Correctional Center near New York City, pending trial on charges he had menaced his wife.

Amid worries that he was mentally ill he was transferred to a medical observation unit. In court documents obtained by the BBC, he claims at night a rat "or similar rodent" emerged from a hole in his mattress and bit him on the penis and hand, drawing blood.

The ruling now allows him to take legal action against the County Officials.
